Terms and Conditions

These Terms and Conditions set out the terms of participation in the engflick 2015 competition (the “Competition”), which also include the engflick 2015 – Competition Guidelines (www.engflick.com.au/competition/) If there is any contradiction between the Terms and Conditions and the engflick 2015 – Competition Guidelines, then the Terms and Conditions take precedence.

  1. The promoter of the Competition is The Institution of Engineers Australia trading as Engineers Australia (the “Promoter”) (ABN 63 020 415 510), Engineering House, 11 National Circuit, Barton, ACT, Australia.
  2. The Competition, engflick 2015, is a short cinematic film competition seeking young filmmakers to help tell the story of the engineered world in a film of between 40 seconds and 5 minutes duration (a “Film”).
  3. Entry to the Competition is open to Australian residents and is free. An entrant must be an individual or a school. Other organisations (including body corporates) are ineligible to enter. Individual entrants under 18 years of age need to have the consent of their parent or guardian. Employees of the Promoter , Judges of the Competition, and any organisation or individual associated with the provision of the non monetary prize(s), are not eligible to enter.
  4. Each entry must be entered in accordance with these Terms and Conditions. By entering the Competition, each entrant agrees to be bound by these Terms and Conditions. The Promoter may in its discretion refuse to award any prize to any entrant who fails to comply with these Terms and Conditions. All relevant instructions on the Promoter’s website (if any) form part of these Terms and Conditions.
  5. The Competition opens at 9.00am Tuesday 23rd June 2015 (AEST) and closes at 5.00pm on Friday, 13th November 2015 (AEST) (“Competition Period”). Any entry received after the expiry of the Competition Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries.
  6. To enter the Competition, you must:
    1. upload your Film to your own YouTube account;
    2. notify the Promoter of your entry online via www.engflick.com.au and complete the entry details online (which must include your name, contact phone number and valid email address to be considered a valid entry).
  7. You may enter the Competition more than once. For each entry, you must complete the entry requirements in clause 6.
  8. To be eligible for a prize your Film must:
    1. meet the theme of “Engineering: No Problem Too Big or Too Small”.
    2. Include an image, graphic or object of a ‘measuring device’, in any form.
    3. Only include original material created by you created solely for the purpose of the competition;
    4. Comply with these Terms and Conditions;
    5. Not breach any intellectual property rights of any other person;
  9. All entries become the property of the Promoter and will not be returned to the entrants.
  10. By submitting your Film to the Promoter, you grant the Promoter and its licensees and assignees a non-exclusive licence to exercise all rights in perpetuity throughout the world in your Film and all other material provided by you to the Promoter pursuant to this Competition at any time.
  11. Without limiting the rights granted to the Promoter under clause 10, you acknowledge the Promoter may exercise any of the following non-exclusive rights throughout the world:
    1. the right to communicate your Film in whole or in part to the public on any media platform; and
    2. the right to provide a free download of your Film in *.mpeg, *.avi or other format that is downloadable from the Website; and
    3. the right to use your Film for promotional purposes.
  12. Your Film may be edited or adapted at any time by the Promoter for any reason including in order to comply with any regulatory requirements of any authority anywhere in the world.
  13. You acknowledge that the Promoter may allow users to view, listen to, reproduce, download and otherwise deal in the copyrights attached to and embodied in your Film. The Promoter aims to ensure that any use of your Film not authorised by the Promoter will not occur, however you acknowledge that the Promoter is not equipped with mechanisms to prevent unauthorised use of your Film, and you accept that, to the extent allowable under the law, the Promoter has no liability to you for how the end user elects to use your Film, and as such it may be permanently stored, reproduced, copied, distributed or the like, without recourse or remedy against the Promoter.
  14. There are 4 prizes to be won, 3 prizes for individual entries and 1 prize for school entries.
    1. 1st Place – $4000
    2. 2nd Place – $1500
    3. 3rd Place – $500
    4. Schools Prize – Lego Mindstorm NXT2.0 Education sets valued at $1200
  15. Chance plays no part in determining the prize winners. The Promoter’s panel of judges will individually assess each Film against the following elements:
    1. Creativity;
    2. Conveyance of an engineering message; and
    3. Audience engagement,

    and score each Film. The scores of all judges will be averaged for each Film to produce an Overall Score for that Film. The Film of an individual entrant with the highest Overall Score will be awarded the First Prize; the Film of an individual entrant with the second highest Overall Score will be awarded the Second Prize, the Film of an individual entrant with the third highest Overall Score and the School entry with the highest Overall Score will be awarded the Schools Prize. If any individual prize winner is under the age of 18 years, the prize will be awarded to that prize winner’s parent or guardian.

  16. No component of the Schools Prize can be transferred or redeemed for cash. In the event that the Schools Prize becomes unavailable due to circumstances beyond the Promoter’s control, the Promoter reserves the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions made under applicable legislation.
  17. Finalists will be notified by 5.00pm Friday 16th November 2015 (AEST).
  18. Prize Winners will be officially notified by 5.00pm Friday 4th December 2015. Each Prize Winner will be required to provide additional materials comprising:
    1. a photo of the individual entrant or School Group and contributor(s) to be used in promotion of the winning Film;
    2. An electronic copy of the film in one of the following formats provided over the internet or on a DVD sent to the Producer:
      1. MOV
      2. MPEG4
      3. AVI
      4. WMV
      5. FLV
  19. You warrant that:
    1. all details provided with your entry are true and accurate;
    2. you have all necessary rights and licences to grant the rights set out in these Terms and Conditions;
    3. your Film is your original work and has not been previously communicated to the public;
    4. your Film does not contain any other commercial or recorded music;
    5. you are the copyright owner or authorised licensor of all copyright works and subject matter comprising your Film (including the film, sound recording, musical and literary works);
    6. the exercise of the rights granted to the Promoter in these Terms and Conditions will not infringe the rights of any third parties; and,
    7. you will indemnify the Promoter against any loss or damage resulting from any breach of these warranties.
  20. You acknowledge that the Promoter is under no obligation to exercise any of the rights granted to it by these Terms and Conditions, and providing downloads and any communication of your Film to the public by the Promoter is at the complete discretion of the Promoter.
  21. You agree that the Promoter may use your entry and any personal details provided to the Promoter for any promotional, marketing and publicity purposes of the Promoter in any media without notice and without any fee being paid to you.
  22. Decisions of the Promoter and its panel of judges are final and will be binding on each person who enters the Competition and no correspondence will be entered into.
  23. If there is any event that prevents or hinders the Promoter’s conduct of the Competition or the Promoter’s ability to deliver the prize/s to the prize winner/s of the Competition, the Promoter may, in its discretion, cancel the Competition and recommence it at another time under the same conditions or select another winner.
  24. The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error that may occur in the course of the administration of this Competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
  25. To the full extent permitted by the law, the Promoter will not be liable for any injury, damages, expenses, or loss whatsoever (whether direct or inconsequential) to persons or property as a result of any person entering into the Competition or accepting or using any prize, including without limitation non-receipt of any prize or damage to any prize in transit and the School Prize winner’s failure to comply with any terms and conditions specified by any third party in relation to the Schools Prize.
